Entry fees cover registration processing, competition administration, and participation opportunities described in the official entry materials.

Only prizes specifically advertised or confirmed in writing are guaranteed, subject to these terms and applicable law.
If a particular award item becomes unavailable due to circumstances beyond the organization's reasonable control, Miss Pachuco Ball may provide an item of reasonably comparable value and significance, where legally permissible.
Titles may be revoked following substantiated serious misconduct, material rule violations, fraudulent registration, or other grounds expressly established in published titleholder requirements.
Contestants do not acquire ownership rights in the Miss Pachuco Ball name, logo, trademarks, or organizational materials by receiving a title.
9. Photography, Video & Promotional Authorization
Miss Pachuco Ball is a public-facing cultural and entertainment event where photography, video recording, livestreaming, and media coverage may occur.
By participating, contestants grant the organization a nonexclusive, worldwide, royalty-free license to use photographs, video recordings, names, likenesses, and event-related statements captured or voluntarily submitted in connection with their participation.
Such materials may be used for legitimate event-related purposes, including:

For minors, the parent or legal guardian grants this authorization on the minor's behalf to the extent permitted by law.
This section does not transfer ownership of independently copyrighted photographs or other materials belonging to third-party photographers.
10. Event Changes & Unforeseen Circumstances

IMPORTANT LEGAL AGREEMENTS
THE FOLLOWING SECTIONS ADDRESS PHYSICAL INJURY, RELEASE OF LIABILITY, FINANCIAL RESPONSIBILITY, AND LEGAL DISPUTES. THEY ARE MATERIAL CONDITIONS OF PARTICIPATION.
12. Express Assumption of Risk — In-Person Participation
PLEASE READ CAREFULLY. PARTICIPATION IN MISS PACHUCO BALL INVOLVES RISKS OF PHYSICAL INJURY, PROPERTY DAMAGE, AND OTHER LOSSES.
The contestant acknowledges that Miss Pachuco Ball is an in-person event conducted in an environment that may include stages, elevated platforms, backstage areas, lighting and sound equipment, electrical cables, vehicle displays, parking areas, crowds, and other potential hazards.
Foreseeable risks include, without limitation:
-
Slips, trips, falls, and collisions.
-
Injuries associated with stairs, ramps, platforms, or stage surfaces.
-
Injuries resulting from high heels, costumes, accessories, or wardrobe equipment.
-
Crowd movement and accidental physical contact.
-
Falling or shifting objects and equipment.
-
Exposure to loud music, flashing lights, heat, or weather conditions.
-
Vehicle-related accidents occurring in event parking, display, or permitted activity areas.
-
Injuries caused by the acts or omissions of other participants, guests, or third parties.
-
Loss, theft, or damage to personal belongings.
Such incidents may result in minor or serious bodily injury, permanent disability, or, in extreme circumstances, death.
THE CONTESTANT KNOWINGLY AND VOLUNTARILY ASSUMES THE INHERENT AND ORDINARY RISKS ASSOCIATED WITH PARTICIPATING IN THE EVENT, INCLUDING RISKS THAT MAY NOT BE FULLY ANTICIPATED AT THE TIME OF REGISTRATION.
This assumption of risk applies only to the extent permitted by applicable law and does not eliminate legal duties that cannot lawfully be waived.
13. Release of Liability & Covenant Not to Sue
THIS SECTION AFFECTS IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING CERTAIN CLAIMS FOR PERSONAL INJURY.
For purposes of Sections 12–15, "Released Parties" means:
[Full Legal Name of Pageant Operating Entity], doing business as Miss Pachuco Ball, together with its owners, officers, directors, employees, agents, volunteers, and authorized representatives.
The term also includes Mr. Blue's Pachuco Ball's operating entity, participating venue owners and operators, event producers, contractors, and sponsors, but only to the extent each is an intended beneficiary of this agreement and legally entitled to enforce the applicable provision.
TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, THE CONTESTANT VOLUNTARILY RELEASES AND DISCHARGES THE RELEASED PARTIES FROM CLAIMS FOR PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM PARTICIPATION IN MISS PACHUCO BALL, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.
This release applies to covered incidents occurring during authorized rehearsals, check-in, competition activities, backstage preparation, stage appearances, and participation in designated event areas.
It is intended to include ordinary-negligence claims involving such matters as stage conditions, event equipment, crowd management, routine event operations, and similar participation-related circumstances.
To the fullest extent permitted by law, the contestant agrees not to initiate or maintain a claim against a Released Party for a loss expressly covered by this valid release.
THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESS MISCONDUCT, WILLFUL OR INTENTIONAL MISCONDUCT, FRAUD, OR ANY LIABILITY THAT CANNOT LAWFULLY BE RELEASED OR WAIVED.
Nothing in this section prevents a contestant from asserting nonwaivable legal rights.
14. Medical Emergencies & Financial Responsibility
In the event of an apparent medical emergency, the contestant authorizes Miss Pachuco Ball personnel to contact emergency medical services and communicate reasonably necessary information to emergency responders.
For minor contestants, the parent or legal guardian authorizes the organization to seek emergency assistance when the guardian cannot immediately be reached.
This authorization does not require the organization to provide medical treatment or assume responsibility for services provided by independent medical professionals.
Contestants and their parents or guardians, as applicable, remain financially responsible for medical treatment, ambulance services, transportation, and other personal medical expenses except to the extent such expenses are legally recoverable from another responsible party.
Miss Pachuco Ball does not represent that it provides individual accident, medical, disability, or personal-property insurance for contestants.
15. Parent or Guardian Consent & Minor Participant Release
When a contestant is younger than 18, the undersigned parent or legal guardian:
-
Certifies that they have legal authority to consent to the minor's participation.
-
Confirms that they have reviewed the event requirements and foreseeable risks.
-
Authorizes the minor to participate in approved competition activities.
-
Accepts responsibility for required supervision and compliance with published rules.
-
Consents to the assumption-of-risk and release provisions on behalf of the minor to the extent legally permitted.
-
Releases their own individual claims arising from the minor's participation to the extent those claims may lawfully be released.
The parent or legal guardian understands that California law determines the enforceability and scope of a release executed on behalf of a minor.
NO PROVISION OF THIS AGREEMENT IS INTENDED TO WAIVE CLAIMS OR RIGHTS OF A MINOR THAT CANNOT LAWFULLY BE WAIVED.
The organization may require a separate parental consent and liability acknowledgment bearing the parent's or legal guardian's electronic or handwritten signature before permitting the minor to participate.
16. Indemnification & Third-Party Claims
To the fullest extent permitted by law, adult contestants agree to indemnify and hold harmless the Released Parties against reasonable third-party claims, damages, and expenses, including reasonable legal fees where recoverable, to the extent directly caused by the contestant's:
-
Intentional misconduct or unlawful acts.
-
Material violation of these Terms & Conditions.
-
Intentional destruction of property.
-
Negligent conduct that causes injury or damage to another person or their property.
This indemnification obligation does not require a contestant to indemnify a Released Party for that party's own negligence, gross negligence, intentional misconduct, or other conduct for which indemnification is prohibited by law.
For minor contestants, a parent or legal guardian assumes only those separate contractual responsibilities expressly accepted and legally enforceable against that parent or guardian.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Miss Pachuco Ball shall not be responsible for indirect, incidental, special, or consequential economic losses arising from participation, including lost income, lost business opportunities, independently incurred travel expenses, or similar losses.
For claims arising solely from an alleged breach of this registration agreement involving economic loss, the organization's aggregate contractual liability shall not exceed the entry fees actually paid by the claimant for the applicable competition, except where a greater remedy is required by law.
This limitation does not apply to legally recoverable personal injury damages, gross negligence, reckless or intentional misconduct, fraud, or violations of nonwaivable statutory rights.
Nothing in this section restricts a remedy that California or federal law prohibits the parties from limiting.
18. California Governing Law & Binding Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST COVERED DISPUTES TO BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN A COURT TRIAL.
18.1 Governing Law
These Terms & Conditions shall be governed by the laws of the State of California, without regard to conflict-of-law principles, except where controlling federal law applies.
The Federal Arbitration Act shall govern the interpretation and enforcement of this arbitration agreement to the extent applicable.
18.2 Informal Dispute Resolution
Before initiating arbitration, either party shall provide written notice describing the dispute, relevant facts, and requested resolution.
Notices to Miss Pachuco Ball shall be delivered to:
[Official Contact Email Address]
The parties agree to make a good-faith effort to resolve the dispute informally for 30 calendar days following receipt of the notice.
This process does not prevent either party from seeking emergency relief or taking action necessary to preserve a legal claim before an applicable deadline.
18.3 Binding Individual Arbitration
Except for the exclusions stated below, disputes arising out of or relating to registration, participation, payment, competition administration, awards, these Terms & Conditions, or the relationship between the contestant and Miss Pachuco Ball shall be resolved through final and binding individual arbitration.
This includes covered contractual, statutory, consumer, and tort claims, including personal injury claims to the extent they are legally arbitrable.
Arbitration shall be administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, including consumer due-process protections.
The arbitrator shall be neutral and authorized to award all individual remedies available under applicable law.
The arbitrator shall issue a written decision sufficient to explain the award as required by applicable arbitration rules.
18.4 Riverside County Arbitration Location
The parties agree that Riverside County, California, shall be the designated location for in-person arbitration hearings, to the extent permitted by applicable law.
The parties may mutually agree to conduct arbitration remotely through video conference, telephone, or written submissions when allowed by the applicable rules.
If governing law or applicable consumer arbitration protections require a different location or procedure, those mandatory requirements shall control.
Unless otherwise required by law, court proceedings concerning arbitration that are properly brought in Riverside County shall be filed in a court of competent jurisdiction located in Riverside County, California.
18.5 Arbitration Fees
Arbitration fees and costs shall be allocated in accordance with applicable California and federal law and the AAA Consumer Arbitration Rules.
Miss Pachuco Ball shall pay the administrative and arbitrator fees allocated to the business under those rules or required by law.
No contestant shall be required to pay arbitration fees exceeding amounts permitted under applicable consumer protection laws.
Each party ordinarily bears its own attorney fees, except where an applicable statute, enforceable agreement, or authorized arbitral award provides otherwise.
18.6 Exceptions to Arbitration
This agreement does not require arbitration of:
-
Eligible claims brought in small claims court.
-
Claims that applicable law prohibits from being subjected to predispute arbitration.
-
Sexual assault or sexual harassment disputes for which a person entitled to do so elects judicial resolution under applicable federal law.
-
Requests for public injunctive relief that must remain available in court under California law.
-
Other claims or remedies that cannot lawfully be subjected to mandatory arbitration.
Nothing in this agreement prevents a person from communicating with law enforcement, filing an authorized governmental complaint, or exercising nonwaivable statutory rights.
18.7 Individual Proceedings & Class-Action Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, THE PARTIES AGREE THAT COVERED CLAIMS SHALL BE BROUGHT ONLY IN THEIR INDIVIDUAL CAPACITIES, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
The arbitrator may award individual relief to the extent authorized by law.
This provision does not waive any right to seek public injunctive relief or pursue any proceeding that cannot legally be waived.
The class-action waiver is severable from the remainder of this arbitration agreement to the extent permitted by law.
18.8 Jury Trial Waiver
FOR COVERED DISPUTES THAT ARE VALIDLY SUBJECT TO BINDING ARBITRATION, THE CONTESTANT AND MISS PACHUCO BALL UNDERSTAND THAT THEY ARE GIVING UP THEIR RIGHTS TO HAVE THOSE DISPUTES DECIDED BY A JUDGE OR JURY IN COURT.
The parties retain their rights to pursue excluded or nonarbitrable claims in an appropriate court.
18.9 Enforcement & Severability
The arbitrator's award may be entered and enforced in any court having jurisdiction.
If a particular arbitration provision is found invalid or unenforceable, it shall be severed to the extent legally permissible, and the remaining provisions shall continue in effect.
If an entire claim is determined to be nonarbitrable, that claim may proceed in a court of competent jurisdiction without automatically invalidating the remaining enforceable portions of this agreement.
Questions of arbitrability shall be resolved by the court where applicable law requires judicial determination.
19. General Legal Provisions
Entire Agreement: These Terms & Conditions, together with incorporated official competition rules and any separately executed consent documents, constitute the applicable agreement governing participation.
Severability: If any provision is held unenforceable, the remaining provisions shall continue in effect to the fullest extent permitted by law.
No Waiver: Failure by the organization to enforce a particular provision on one occasion shall not automatically constitute a waiver of its right to enforce that provision in the future.
Changes: Miss Pachuco Ball may update its terms for future registrations. Material amendments affecting an already accepted contestant shall not apply retroactively without any consent required by law.
Third-Party Beneficiaries: Released Parties identified in Section 13 are intended third-party beneficiaries of the liability protections expressly granted to them, to the extent legally permitted.
Electronic Agreements: Electronic acknowledgments and signatures may be used to establish acceptance of this agreement in accordance with applicable electronic signature laws.
Nonwaivable Rights: Nothing in these Terms & Conditions eliminates any right or remedy that cannot lawfully be waived under California or federal law.
20. Final Acknowledgment & Agreement
BY ELECTRONICALLY SIGNING OR AFFIRMATIVELY ACCEPTING THESE TERMS, I CONFIRM THAT:
-
I have been given an opportunity to read and understand these Terms & Conditions.
-
I understand the competition's eligibility requirements, registration policies, and code of conduct.
-
I acknowledge the risks associated with participating in an in-person event.

-
I voluntarily agree to the applicable terms as a condition of participation.
-
If registering a minor, I certify that I am the minor's parent or legal guardian and possess authority to provide the required consent.
